Terms of Service:
Your Agreement with Hostvola.com

Please carefully read the following Terms of Service, as they govern your use of the Hostvola.com website and hosting services. By accessing or using our services, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, please do not use our services. This legal agreement helps us protect our rights and ensure we can provide our service to you consistently at Hostvola.com.

General

HostVola, will provide services to customers described in the website (HostVola.com) subject to the following TOS – Terms of Services. The TOS include general terms and conditions for using our products/services.

Privacy

Please check our Privacy Policy Terms.

User Content

The following are list of some of the websites permitted in our hosting:

  1. Business and Personal websites
  2. Information Depositories, News, Medical Websites
  3. Knowledge, communication, research websites
  4. PTC and PPC websites

The following websites are not allowed:

  1. HYIP, Ponzi websites
  2. Phishing and Fraudulent websites
  3. Pornography websites/li>
  4. Torrent websites
  5. Hate websites
  6. Illegal adult websites
  7. Unlicensed banking websites
  8. Proxy scripts
  9. Warez websites
  10. Violence inciting and racism websites
  11. Websites distributing malware, viruses, hacking tools etc.
  12. IRC software
  13. Websites selling unlicensed software
  14. Copyright material and names such as companies, banks etc. are not allowed for domain registration and web hosting. We have the right to cancel/terminate/suspend the domain/hosting if a copyrighted domain or hosting is used or if we get a complaint from the domain registrar or data center or any official authorities without any prior intimation to the customer.

If we come to know that any of the above mentioned websites or any type of illegal/illegitimate websites are used or if we receive any abuse complaint, we will immediately cancel/terminate the site without giving any prior intimation or warning to the client.

KYC Details

We will suspend/terminate your hosting or domain immediately without any prior warning to the customer if we get any copyright, spamming or any other kind of abuse complaints from the registrar, data center or any other official body.

Termination Policy
VPS Servers and Shared Hosting

Your hosting account will be terminated anytime after the “Third Invoice Overdue Notice” is sent. This policy is applicable to both Shared Hosting and VPS Servers.

Dedicated Servers

Your Dedicated Server can be canceled/terminated anytime depending on the Data Center rules if payment is not received after the First Invoice Overdue Notice is sent. Make sure you make payment before the due date for Dedicated Servers.

Backup Policy

Backup policy is not available for VPS Servers, Dedicated Servers and Cloud Services. Clients will be solely responsible to take backup of their data in these servers. HostVola will not held accountable for any data loss. No legal claim or insurance claim would be liable for any data lost in these servers. HostVola offers services to host websites only and not to store any data or information. Using any account for online storage for archiving electronic files is not permitted and can result in cancellation or termination of services without any intimation.

Daily backup is available for shared hosting accounts only. We will try our best to provide a backing system and keep backup copies of shared hosting accounts. However, customers should keep a backup of their websites, databases, software and all hosted content from their end. HostVola will not be responsible in any way for loss of data.

Data Recovery

It will not be possible to recover your data after your hosting is terminated. You data will be wiped/deleted the moment you send a cancellation request for your hosting services and it will not be possible to recover your data. Therefore, make sure you think twice before sending a service cancellation request specifically when you choose the “Immediate Cancellation” request. When you choose “Immediate Cancellation”, your hosting account will be terminated instantly and your data will be wiped and it would not be feasible to recover your data. HostVola will not be responsible for any data loss or for recovering your data because of this. It will be the responsibility of the customer to make sure that they take backup of their data prior to sending a cancellation request.

Refund Policy

7 Days Refund Policy on the following services.

  • Shared Hosting Plans (Plan Names: Vola V1, V2, V3 and V4)

No refund policy is available on the following services. Customers will not get any refund on the following services under any circumstances:

  • VPS Servers
  • Dedicated Servers
  • Domain Names
  • SSLs
  • Email Services
Payment Claims/Dispute

We reserve the right to immediately terminate customer service/account without any prior intimation/notice if the customer opens a claim or dispute against us or if there is a charge back.

Copyright/Spamming/Abuse Complaints

We will take immediate action against a customer’s account and have the right to terminate the account without prior notice if we receive any Copyright, Spamming or Abuse complaint.

Support Policy

Support will be provided to customers for services/products bought only from us. We will not provide support for any services or products procured from elsewhere including Domains, Hosting, SSL Certificates etc.

IP addresses

It will be the responsibility of the customer to take care after IP Addresses allotted to them. HostVola is authorized to remove and change any IP addresses if required.

Instant setup

Shared hosting packages are setup instantly once order is placed and payment is completed.

Free transfer

We offer free migration if you purchase hosting from us. We will assist you to migrate your data when you purchase hosting from us. This is applicable for new orders only and we will assist you with the migration if your current hosting is cPanel based hosting only.

Service support

It is our endeavour to provide fast support and best services to our customers. The average first response time at HostVola is 1 hour and we strive to achieve an average of 6 hours resolution time. Please note that the resolution time mentioned is average time and it also depends on the nature/complexity of the issue.

Resource usage

Account holders need to ensure that they follow resource usage rules diligently for their account/s or else we will have to take action against the accounts to balance consumption of resources and maintain our service quality/level. We have resource usage monitoring/limiting software in place at HostVola for shared hosting accounts. In case, if any particular website utilizes more than their allotted resources and breaches the resource consumption rules, then the hosting package of the website will need to be upgraded or we will have to cancel/terminate the concerned account and HostVola will not be bound in any way to give a refund.

Mail usage

Customers are permitted to send a timely and reasonable number of emails from their hosting accounts. However, spamming is not allowed at all. Therefore, only emails are permitted to sent to only opt-in email addresses. Emails sent to purchased/acquired email lists can result in suspension/cancellation of the account. Customers also need to follow content rules of sending emails. Kindly contact the support team for further information on this this.

Uptime

HostVola assures 99.9% uptime to all customers. Nevertheless, uptime is measured on the basis of network. Therefore, if websites face downtime because of natural calamities, hardware failure and other situations beyond our control will not be covered in the Service Level Agreement (SLA).

Cronjobs

Shared hosting accounts/customers are not allowed to set cronjobs below 5 minutes.

Billing and Payment Policy

Customers are required to make payments on time for their products or services. Delays or default in payments can result in suspension/termination/cancellation of the product/service. Any customer’s payment not received or gets reversed, will result in termination of the product/service without any prior notification. Extra charges for restoration and renewal will be charged for services that are canceled, terminated or suspended. Late fee will be applied to overdue invoices or invoices not paid on time by customers.

Service Suspension Policy

We follow Indian Standard Time (IST) in our system. For example, if the due date of your service is on April 1. When it is 12:00 AM on April 1 and if the payment is not received, the service will be immediately suspended. Therefore, it is advisable to make payment 1 or 2 days before the due date of the service to avoid suspension.

Pre-Approved Payments and Auto Subscriptions

If any customer does not cancel their auto subscription when they they cancel their service, then we will not be liable to refund the payment and the payment received will be credited to the customer’s HostVola account. The credit balance can be used by the customer to make payments for future purchase of services. Moreover, it will be the sole responsibility of the customers to cancel their recurring payments/auto subscriptions to HostVola if their service is cancelled/terminated.

Service Suspension Policy

When a customer places an order at HostVola, then our server resources and space are reserved . Therefore, customer has to make payment for their dues whether they use the resources fully or partially.

No Spam Policy

We take spamming very seriously and have a zero tolerance policy towards spamming. Purchased mailing lists, commercial/unsolicited bulk emails or emails not subscribed or opted-in for customer website will result in suspension of the account or penalty. HostVola has the sole authority to determine whether the bulk mail recipients had opted-in or opted-out. Customers are required to follow the rules and regulations of Can Spam Act and HostVola.

No Abuse

We strive to offer best services to our customers. We will not allow and tolerate any threatening, defamatory or abusive language or behaviour towards our organization, company and employees from any customer.

Any means of communication with HostVola employees, customers and third-parties should not be transmitted or circulated on other websites, blogs, forums, surveys, in person, by telephone or any other way/platform unless a written permission is given by our company. Any kind of breach of this will result in suspension, cancellation, termination, legal action or any action at our sole discretion to enforce privacy policy.

Reselling

Clients having reseller account can only resell resources and services offered by HostVola (subject to our TOS). Any client will not me permitted to connect with other clients in the premises and any clent will not be permitted to buy our products/services in partnership with others. It will be the sole responsibility of the resellers to provide support to their customers. HostVola will not be obliged to offer support to the customers of resellers. If a reseller’s customer contacts HostVola for any assistance or support, then HostVola has the right to put the customer account on hold. Due to security reasons, Resellers must submit any support requests for their customers.

Affiliates

Customers are advised to go through our affiliate terms mentioned below prior to becoming an affiliate at HostVola.

  1. Affiliates are strictly not allowed open multiple accounts at HostVola or to self-refer themselves in order to receive affiliate commission.
  2. We can ask any affiliate to providing identification proofs prior to giving affiliate commission.
  3. HostVola has the right to suspend reseller account or cancel/revoke the affiliate commission if the affiliate terms or any other terms are not met.
  4. Making use of proxies to register or login to our website (HostVola.com) can result in cancellation/suspension of the affiliate account.
  5. Commission will be given to the sponsor only if referral buys a new service or product.
  6. Commissions are given on VPS Hosting and Shared Hosting purchases only and not any other product/service.
  7. You need to make sure that an Affiliate joins under his/her account to be eligible to receive commission. it is mandatory for the referral to be reflected under your HostVola account to receive commission or else commission will not be given.
Change in Prices

Our Product and Service prices can be changed anytime without prior intimation. HostVola reserves the right to modify the prices anytime without any advanced notice.

Software License Prices

Prices of software licenses can be revised anytime whenever there is an increase in cost at the vendor’s end or due to fluctuations in currency. A separate invoice can be created and issued to the customer for the balance period in case if the customer has made an advanced payment. This separate invoice needs to be paid by the customer immediately. If the customer fails to pay the invoice, it can result in cancellation of the license.

Customer responsibility

The client is fully accountable for the backup and content served and stored by his hosting/servers. HostVola will not be accountable in any misuse or damage or loss of backup, content or data. HostVola will also not be liable for any legal or insurance claims for data/backup loss. Customers are not permitted to use their hosting accounts for storage purpose or dump website. Customers will be completely responsible for any claims opened for copyrighted content found in their website or hosting account.

No Partnership or Collaboration

HostVola does not consider the parties to establish a collaborative or joint association, or partnership between the customer and HostVola. Nothing mentioned in the TOS should be interpreted as creating an kind of partnership or joint venture between HostVola and the customer.

Force Majeure

HostVola reserves the rights to terminate/cancel this Agreement without any obligation to customers in any unavoidable event or circumstances beyond HostVola’s control/power, whether foreseeable when undertaking the Agreement, in response of which HostVola is not able to adhere to it’s commitment in this TOS. Unavoidable events include, however not limited to: acts of God, war, natural calamities, epidemics, floods, earthquakes, fires, insurrection, embargoes, labor disputes, governmental orders/regulations or similar acts, temporary non availability of server, hardware or software or network via which HostVola services are offered, non availability of permits, licenses or permissions by government authorities.

Intellectual property rights violation

We do not permit any kind of violation of an entity’s or person’s intellectual property rights, publicity rights or privacy rights. HostVola, by law is required to remove access or block access to content from customer’s service/account upon receipt of copyright or legal violations.

Communication information exaggeration

HostVola does not allow removing, omitting imitating, misrepresenting message headers, IP (IP addresses) or returning mailing informaion in order to misidentify or hide the message origin.

Jurisdiction and Law

This Agreement/TOS is governed by the laws of Gujarat state and laws of India. The parties need to submit any disputes arising out of this TOS/Agreement, to Rajkot city courts, judicial district of Gujarat, India.

Consequences of violation

Any violation of this AUP/TOS will be subject the customer to civil or criminal liability. HostVola, in its sole discretion, can apprehend what action is taken in step with violation of this TOS/AUP. A violation of the AUP, can result in, but not restricted to permanent or temporary blocking of client’s information or equipment, suspension/termination of services. HostVola can involve or collaborate with law enforcement agencies to investigate suspected wrongdoers. Neither HostVola nor does its associates have any commitment to warn customer and can cancel customer account without giving any prior intimation if the customer violates the TOS.

Rights and Changes

The TOS and AUP are subject to change. The company can make changes as per the prevailing circumstances in order to provide best services. The website content, product/service prices, plans, packages can change anytime without advanced notification. Customers are advised to visit our Announcements page on a regular basis.

We follow all legal systems in an ethical manner. Customer account information can be given to investigating teams or legal authorities to cooperate with the authorities if a claim arises to get a proper judgement.
